Fencing around the property

we are having some problems regarding ur fence around the house. one portion of the property has not been fenced as tall as the other parts because of fear that the adjacent owner might not have the same lighting that it presently gets from the sun during the daytime. Trouble is they have built their house right on the boundary line. how should we go about this?...tnxz

Isn't there a code that the neighbor has to build a certain feet away from the border of the properties.

I think it is very nice that you are taking your neighbors sunlight into account before building your fence.  You really do have the right to put one up regardless of it blocking their sunlight as long as you follow your towns code.

I would check with the town's code, too. If the neighbor has violated it, I wouldn't feel too bad about putting up the fence how I want it. :)

thnx guys! actually, its not just a town code but its been in the civil code alright. but then again, you cant choose your neighbors and its far more stressful fighting it out with anyone from the neighborhood than merely finding of a way to remedy this, aint....but anyway, when there's no other way, id follow my right.... ;)

YOu are extremely nice.

If I had found out that code was on my side, I would have built the fence.  Then, when the neighbor complained to me about it, I would give him the phone number for the nearest Home Depot and tell him they have great sky lights that would probably work well for him!

It's their fault that they built their house right on the boundary line. Do you know that they've actually broken a regulation? When we were renovating our house, our architect and engineer was very particular about it.Actually, I wasn't aware about it before, but thanks to them, at least I won't be having problems in the future.

Nice of you, but at the same time if they have some problem you should immediately react towards to that. If you were right go ahead and sue them.
